ETRO 21/21

The works and road restrictions that form the Corstorphine Connections project has been introduced under an Experimental Traffic Order (ETRO).

​

The decision on how to exercise their functions under the 1984 Act lies with each local authority. Nevertheless, when advancing TROs, they are obligated to adhere to the procedural requirements outlined in the Local Authorities Traffic Order (Procedure) (Scotland) Regulations. These regulations dictate aspects such as the publication of proposals and the handling of any objections received.

Traffic authorities in Scotland already also have powers to make ETROs for the purpose of carrying out an experimental scheme of traffic control. These can have effect for up to 18 months.

 

ETROs are currently very rarely used in Scotland. Local authorities consider they offer little benefit as the procedure for such orders does not provide for a proper way to consult and modify along the way.

 

Even when putting an ETRO in place, if a local authority considers there is suitable justification for the measures to remain permanent the full TRO process must be followed which potentially allows concerns already addressed to be made again by objection and potentially a time consuming and costly Public Local Inquiry. Traffic Regulation Orders (transport.gov.scot)

The ETRO currently in force in Corstorphine is ETRO/21/21, which was introduced in May 2023. As of January 2024, the ETRO has been modified and is now referenced Modification Order 2023 - ETRO/21/21

On 24/5/23 The City of Edinburgh Council gave notice that it had made ETRO/21/21 which introduced various restrictions in the Corstorphine area pursuant to sections 9 and 10 of the Road Traffic Regulation Act 1984.

From the 8th January 2024, the following amendments were made:

In SCHEDULE 2 In column 2 of item Manse Road (east side), where it second appears, the words “from a point 14 metres or thereby south of the extended south kerbline of Featherhall Terrace for a distance of 26 metres or thereby northwards” were deleted and there were inserted the words “Not used”.

 

In SCHEDULE 7 All of the words after “there were inserted the words: -“ were deleted and there was inserted:
